1. Introduction:
Welcome to MWG Web Designs. These Terms and Conditions outline the rules and responsibilities for clients who engage our website design services. By using our services or accessing our website, you agree to these Terms. If you do not agree, please do not continue to use our services.
2. About Us: MWG Web Designs is a website design business based in the United Kingdom. We create and maintain custom websites for UK-based businesses using the Wix platform.
3. Services: We provide website design, setup, and related digital services. Specific project details (such as features, timelines, and pricing) will be outlined in your individual service agreement, quotation, or invoice. We may showcase completed work, including screenshots, links, or design elements, in our portfolio or on social media — only with your consent.
4. Client Responsibilities: To enable us to complete your project, you agree to: Provide accurate and complete information, including text, images, logos, and other materials required for your website. Ensure that all materials provided do not infringe any copyright, trademark, or third-party rights. Review and approve drafts in a timely manner to avoid project delays. Maintain a valid PayPal account for payment, where applicable.
5. Payments and Refunds: Payments are processed securely via PayPal. A deposit or full payment may be required before work begins, depending on the project. Final payment must be received before your website goes live or is transferred to your Wix account. Due to the nature of digital design services, refunds are not offered once design work has commenced, except in cases where we are unable to deliver the agreed-upon service.
6. Ownership and Copyright: Upon full payment, customers may choose between full ownership or managed service: Full Ownership: If the customer opts for full ownership of the website, all design, content, and assets (including third-party elements for which proper licenses have been obtained) will be transferred to the client, they will be shown how to purchase the domain and premium plan for their website but MWG has no right to do this for the client. Managed Service: If the customer opts for the managed service, they will be added as a collaborator with appropriate access, while MWG Web Designs retains ownership and management of the website.
MWG Web Designs reserves the right to display completed projects as part of our portfolio unless you request otherwise in writing. Customers are responsible for ensuring that all content they provide (including text, images, and logos) is legally owned or licensed for use.
7. Hosting and Platform: All websites are built using Wix, which provides hosting, functionality, and certain built-in features. MWG Web Designs is not responsible for any downtime, technical issues, or platform changes made by Wix.
8. Revisions and Maintenance: We include a limited number of design revisions as specified in your project agreement. Additional revisions or ongoing maintenance may incur extra fees.
9. Liability: While we take great care in delivering quality work, MWG Web Designs is not liable for: Losses or damages resulting from website downtime, data loss, or third-party service interruptions (e.g., Wix or PayPal). Any indirect, incidental, or consequential damages arising from the use of our services. Client-provided content that is inaccurate, incomplete, or unlawful. Our total liability for any claim related to our services will not exceed the total amount paid by you for that service.
10. Privacy and Data: We handle personal information in accordance with our Privacy Policy, available on our website.
11. Termination Either party may terminate a project by providing written notice. Fees for work completed up to the termination date will remain payable.
12. Governing Law: These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.13. Website Ownership and Maintenance
1) Ownership Options: At the beginning of a website project, clients may choose between: Managed Service: MWG Web Designs retains ownership, the client becomes a collaborator of the Wix site and MWG Web Designs continues to provide ongoing maintenance, updates, and hosting for a recurring monthly fee (For a minimum of 12 months). Full Ownership: The client assumes full ownership of the site. To keep the site live, the client is responsible for purchasing and maintaining their own domain and Wix Premium plan. MWG Web Designs may continue to provide optional maintenance for an agreed fee.
2) Domain Ownership: Domains registered by MWG Web Designs on behalf of the client remain under our account until transferred. If the client requests a domain transfer, MWG Web Designs will provide the necessary authorization and guidance. Clients are responsible for any registrar fees or requirements. Domains registered by the client are fully owned by the client from the start.
3) Maintenance Scope: Ongoing maintenance includes updates, backups, and minor edits as specified in the client agreement. If maintenance fees are not paid, MWG Web Designs may pause services until payment is received.
4) Transfer of Control: Full ownership and control of the site or domain is transferred only when both parties agree and all applicable fees are paid. Once a client assumes full ownership, MWG Web Designs is no longer responsible for the operation, security, or management of the website unless an ongoing maintenance agreement is in place.
